Durham NC Pedestrian Hit and Injured on Emperor Boulevard
A gentleman was seriously injured on Emperor Boulevard in Durham on Tuesday afternoon. The incident happened when the man was walking in a crosswalk somewhere between the intersections of I-540 and South Miami Boulevard.
The driver of the vehicle told investigating police that he was blinded by the sun. The driver was also operating the motor vehicle with a suspended license.
The issue of being blinded by the sun will not protect the driver form liability in this case. Under North Carolina law, all driver’s must operate the vehicle appropriately under the circumstances. If a driver is blinded by the sun, the driver must slow down and operate the vehicle in such a manner as to allow the operator to see and yield when appropriate as apparently was the case here.
