Cary Fire Truck Accident Results in Injuries
We recently read about an unusual accident in Cary, NC involving a fire truck.
The accident happened near the entrance of Green Hope High School on Carpenter Upchurch Road. Unfortunately, there were injuries due to the accident. It is not clear what caused the accident or who was at fault.
Claims against municipalities for the operation of an emergency response vehicle can be quite tricky. In many cases, the municipality will assert a defense called “governmental immunity” which shields local governments from lawsuits and civil liability. In some cases, the municipality will waive this defense through the purchase of insurance but each case must be looked at specifically. A leading appellate court decision on this issue is the 1993 NC Court of Appeals ruling in Taylor v. Ashburn.
