A gentleman named Mark Cox of Michigan was tragically killed in an accident on Interstate 95 near Roanoke Rapids on Friday afternoon.
The accident apparently happened when a minivan failed to slow as it approached stopped traffic on I-95 and the minivan struck another vehicle. Mr. Cox was a passenger in the minivan. Unfortunately, Mr. Cox did not survive. Five other people were injured as well.
This case implicates some laws that may be unique to North Carolina. In some states, a passenger may not have a claim against a negligent driver. However, North Carolina allows claims for injured or killed passengers against the driver of a vehicle. The significance of the claim for Mr. Cox’s wrongful death would likely depend largely on the amount of available insurance.
