On Monday morning a gentlemen in Surf City died from head injuries sustained when he apparently lost control and hit the ground. He was traveling eastbound on Highway 210 at the time of the accident.
The story states that the man was wearing a helmet but that the helmet was not DOT approved.
This terrible accident poses several questions that should be answered including how was this helmet marketed and sold? Was the helmet poorly designed or manufactured? Could this gentlemen’s injuries have been prevented if the helmet was properly designed or manufactured?
I don’t know these answers but fortunately North Carolina’s products liability laws now allow claims for defective products that were purchased as much as 10 years ago. If indeed this helmet was defective and not fit for use, this gentlemen’s family may have a claim related to this accident.
